Acceptance of Terms

These Terms of Service govern your use of Photo Magic Report. By accessing or using the app, you agree to these Terms. If you do not agree, you should not use Photo Magic Report.

Description of Service

Photo Magic Report helps users create marine inspection reports and export reports as PDFs. The app provides tools for entering inspection information, attaching photos, managing report details, and generating report documents from user-entered content.

User Responsibilities

You are responsible for your use of Photo Magic Report, including:

Providing accurate report data and reviewing report contents.
Having authority, permission, or consent to enter client, vessel, company, and contact details.
Ensuring you have rights to uploaded photos and report content.
Not uploading illegal, harmful, misleading, abusive, or copyright-infringing content.

Marine and Professional Disclaimer

Reports are generated from data, photos, and other content entered by users. Photo Magic Report does not certify vessel safety, seaworthiness, regulatory compliance, class status, insurance status, or legal compliance.

Photo Magic Report does not replace professional judgment, classification society review, regulator approval, insurer assessment, or legal advice. You remain responsible for inspection conclusions, professional decisions, report accuracy, and any use or reliance on reports you create.

Subscriptions

Premium access unlocks paid report features, premium report types, unlimited inspection creation, and PDF exports. Payments are handled by Apple App Store or Google Play.

Subscriptions renew automatically unless cancelled through Apple App Store or Google Play before renewal. Restore purchases is available in the app where supported. Refunds are handled by Apple or Google according to their policies. Deleting your Photo Magic Report account does not automatically cancel an Apple App Store or Google Play subscription.

Account Deletion

You can delete your account from the Profile area of the app. Active subscribers may need to cancel their Apple App Store or Google Play subscription first to prevent future renewal or charges through the platform where the subscription was purchased.

Copyright and Takedown

You must own, license, or otherwise have the necessary rights to upload photos, images, text, and other report content to Photo Magic Report. Copyright or takedown complaints may be sent to contact@fathommarineconsultants.com.

Acceptable Use

You must not misuse Photo Magic Report, interfere with the app or its services, attempt unauthorized access, upload malicious content, violate laws, infringe third-party rights, or use the app in a way that could harm other users, service providers, or the operation of the app.

Availability

Photo Magic Report may be updated, interrupted, limited, suspended, or discontinued from time to time. We do not guarantee that the app or any feature will always be available, error-free, or uninterrupted.

Limitation of Liability

Photo Magic Report is provided as-is and as available. To the maximum extent allowed by law, we are not liable for missed defects, inaccurate user entries, inspection conclusions, commercial losses, third-party reliance, lost profits, lost data, business interruption, or indirect, incidental, special, consequential, or punitive damages arising from or related to use of the app or reports generated through it.

Changes to Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date above. Continued use of Photo Magic Report after changes are posted means you accept the updated Terms.
